What You’ll Do
As Counsel, you’ll be the an attorney based in Authentic’s Shanghai office, where you’ll work closely with Authentic’s APAC teams by focusing on dispute resolution, contract enforcement, brand protections and other intellectual property (IP) related legal matters. You will play a pivotal role in protecting and enforcing Authentic’s intellectual property rights and license agreements, and supporting dispute resolution efforts across the APAC region. Your primary focus will be on civil enforcement, litigation support, and brand protection initiatives. This includes working on pre-litigation strategy, managing external counsel, handling enforcement actions, and advising internal stakeholders on risk mitigation and contract enforcement. You will also contribute to the development and implementation of internal processes and policies aimed at protecting the value of Authentic’s global brand portfolio.You'll report to –Vice President, Associate General Counsel, who is based in Shanghai. As a member of the legal team, you will collaborate regularly with Authentic’s Brand Management, Marketing/Communications, Finance, and Operations teams to ensure the protection and enforcement of the company’s global portfolio of iconic brands.
What you’ll be working on
- Manage and support all phases of civil enforcement, from fact-gathering and investigations to preparing and issuing breach notices, termination notices, cease and desist letters, demand letters, and settlement agreements.
- Draft, review, and support the negotiation of IP-related legal documents, including brand protection agreements, license provisions, and enforcement documentation.
- Provide practical and business-focused legal and strategic advice on dispute resolution, contract enforcement, brand protection, and IP-related issues across the APAC region.
- Support litigation and enforcement efforts by preparing case summaries, status reports, budgets, and presentations for internal and external stakeholders.
- Assist in organizing and maintaining internal litigation files, including docketing and case tracking.
- Coordinate with external counsel and assist with the management of legal proceedings involving the company.
- Conduct legal research and draft memoranda, correspondence, and other supporting documentation as needed.
- Contribute to the development and implementation of internal policies, procedures, and compliance programs.
- Provide day-to-day support to the Legal Department, including cross-functional legal guidance as required.
Must Haves:
- 6+ years of law firm and/or equivalent in-house experience focusing on IP enforcement, contract dispute resolution and brand protection matters.
- PRC law degree from a reputable university/law school. Additional law dgree in US, UK or other major common law jurisdictions is preferable but not a must.
- PRC bar qualification is required. Additional bar qualification in US, UK or other major common law jurisdictions is preferable but not a must.
- Strong command of PRC IP laws and familiarity with international enforcement practices. Experience in privacy, corporate/M&A, and/or employment law is a plus but is not required.
- Proven ability to analyze complex legal issues, manage multiple projects simultaneously, and provide sound, practical legal advice.
- Excellent command of written and spoken Mandarin Chinese and English.
- Proficiency with M.S. Office (Word, Outlook).
