JOB SUMMARY
- Reviews and prepares title examination documents for non-consumer real estate secured Association loans and credit servicing actions according to established processes and procedures by evaluating and interpreting title and security history as expressed on title commitments.
- Performs analysis of unique title and ownership issues and determines the legal documentation and requirements in order to close the transaction with a valid and required lien position.
- Prepares title examination requirements and instruments within accepted procedures and guidelines of the Association.
- Assists the credit office during the facilitation of the title examination process in accordance with all applicable Association and FCA policies and regulations, including necessary letter to title company preparation.
- Performs title review and certification of liens covered by title insurance or opinions to make sure Association assets are pledged to the borrowing base.
- Works closely with more experienced title examiners to perform a range of title examination functions from routine transactions through moderately complex loan structures with an average skill level operating under consistent oversight with limited approval authority in daily operations.
ESSENTIAL FUNCTIONS
- Processes assigned loans under supervision of more senior staff. Has a basic understanding of loan documents, title requirements, title documents, and utilizes knowledge to determine necessary documentation requirements per procedures, laws and regulations.
- Effectively communicates with credit office personnel, document preparation specialists, Association attorneys, and title and closing agents.
- Prepares title examination requirements and instruments in compliance with all bank, state, federal and Association policies, procedures, and regulations. Ensures all title requirements are met prior to closing.
- Collaborate with credit office regarding sufficiency of the legal description of the security of the collateral.
- Review commitment for title insurance to substantiate adequacy of the title to meet regulatory and Association requirements.
- Reviews title documents and title exceptions and requirements.
- Awareness of regulatory requirements for consumer and non-consumer loans.
- Reviews documents post-closing, such as title policies, deeds of trust, promissory notes, mechanic's lien contracts, mechanic's lien notes, and title endorsements. Ensures that all documents have been properly signed, witnessed, and notarized by all required individuals.
- Quality control regarding legal requirement, correct security lien position and following policy and procedure during the title examination and certification process.
- Prepares letters to title company and notes to document preparation specialists for real property to ensure adequate lien perfection and preparation of loan and title documents.
