Product Counsel

Flex is a growth-stage, NYC headquartered FinTech company that is creating the best rent payment experience. It’s hard to believe that it’s 2024 and paying rent on time is expensive, inflexible, and difficult. We’re here to change that! Flex enables our users to pay rent throughout the month on a schedule that better fits their finances and budget. Our mission is to empower as many renters as possible with flexibility over their most significant recurring expense. After deliberately keeping a stealth profile as we built up unprecedented investor support and an enthusiastic user base, we are looking for motivated individuals to help us keep our mission growing. Will you be a part of the team?

About the role

We are seeking an experienced product counsel with a background in consumer finance, privacy, and data use to join our in-house counsel team. As Product Counsel, you will be a key, early member of Flex’s growing Legal & Compliance team and you will be a partner to our core B2C and B2B business units as you advise and collaborate with our product, engineering, business, and marketing departments to build Flex’s biller and consumer financial technologies and services.

This rare opportunity is ideal for an entrepreneurial candidate, as you will be empowered to “think like an owner” while you design and collaborate on new products and services from ideation through launch and go-to-market. Your manager will be intensely focused on your development, and how to make Flex an accelerant for your skill-building and career.

What you’ll do

  • Provide comprehensive first-line legal support for initiatives related to Flex’s consumer credit products and services, advising on legal and regulatory issues relating to consumer finance, data privacy, payments, and other relevant areas.
  • Serve as a legal thought partner to product, design, and data teams, ensuring that consumer protection, licensing requirements, and privacy considerations are integrated into new initiatives from the outset, and collaborate with outside counsel as needed.
  • Draft and negotiate program agreements and terms to support strategic partnerships with fintech partners and third-party providers.
  • Guide the business by navigating the regulatory landscape for Flex’s consumer credit products. Ensure that all activities involving data collection, processing, and sharing adhere to relevant laws and regulations.
  • Be an advisor in the company and a critical part of a hyper-growth startup with a proven business line. As we grow and succeed, you will help scale the development of our legal department and the entire company.

Key qualifications

  • 3 - 5+ years of combined experience at a top-tier law firm and/or in-house legal department.
  • Experience providing product counseling for digital lending or payments systems, alternative payments, BNPL, or other similar financial services a plus.
  • Deep understanding of federal and state laws related to consumer privacy and data use; experience counseling data aggregators and users of consumer data and/or consumer reports.
  • Thorough literacy with the regulatory landscape for consumer credit products and services, including TILA/Reg. Z, UDAAP, ECOA/Reg. B, FDCPA/Reg. F, FCRA/Reg. V, EFTA/Reg. E, and similarly applicable state laws.
  • Persistence, drive, and a goal-focused mindset as you own projects from initiation to completion.
  • Strong attention to detail and ability to effectively prioritize tasks within a fast-paced environment.
  • Ability to work independently and as part of a team.
  • A bias for action, clear and concise communication skills, and a willingness to prioritize what truly matters.
  • JD from a top law school and member in good standing of a US state bar.

The national pay range for this role is $175,000-$201,000 in base salary. Individual compensation will be commensurate with the candidate's experience aligned with Flex's internal leveling guidelines and benchmarks.

Voluntary Self-Identification of Disability

Form CC-305
OMB Control Number 1250-0005
Expires 04/30/2026

Why are you being asked to complete this form?

We are a federal contractor or subcontractor. The law requires us to provide equal employment opportunity to qualified people with disabilities. We have a goal of having at least 7% of our workers as people with disabilities. The law says we must measure our progress towards this goal. To do this, we must ask applicants and employees if they have a disability or have ever had one. People can become disabled, so we need to ask this question at least every five years.

Completing this form is voluntary, and we hope that you will choose to do so. Your answer is confidential. No one who makes hiring decisions will see it. Your decision to complete the form and your answer will not harm you in any way. If you want to learn more about the law or this form, visit the U.S. Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) website at www.dol.gov/ofccp.
