Role Title: Associate Counsel, Product and Privacy 

Direct Report: Global Counsel & Data Privacy Officer 

Area: Legal 

Location: San Francisco, CA 

The Opportunity 
Incode Technologies, Inc. is seeking a highly skilled and motivated Associate General Counsel, Product and Privacy to join our legal team. This role will work closely with product, engineering, commercial, and compliance teams to ensure that Incode’s innovative identity verification products comply with global privacy laws and industry standards while supporting the company’s business goals. The successful candidate will be responsible for advising on privacy, data protection, and product-related legal issues and ensuring alignment with regulatory and contractual obligations.  

Qualifications and Requirements: 

Educational Background: 

  • J.D. or equivalent legal degree from an accredited law school. 
  • Member in good standing of a state bar (California or Texas). 

Experience: 

  • 5+ years of experience in privacy, product counseling, or technology law, with at least 2 years focused on privacy compliance.
  • Experience advising on global privacy frameworks (e.g., GDPR, CCPA, LGPD).
  • Proven track record of advising on legal aspects of product design and lifecycle management. 

Skills: 

  • Deep understanding of privacy and security principles, including Privacy by Design and data protection impact assessments.
  • Exceptional ability to analyze and apply complex privacy and technology regulations to innovative product offerings.
  • Strong contract negotiation and drafting skills, particularly for DPAs, MSAs, and vendor agreements.
  • Excellent written and verbal communication skills, with the ability to convey complex legal concepts clearly to non-legal audiences.

Certifications (Preferred): 

  1. Certified Information Privacy Professional (CIPP/US, CIPP/E, or similar) or willingness to obtain certification. 

Key Responsibilities: 

Product Counseling: 

  • Provide legal support and strategic advice to product and engineering teams on product development, launches, and lifecycle management. 
  • Ensure product compliance with global privacy regulations, including GDPR, CCPA, LGPD, and emerging AI and biometric laws. 
  • Draft and negotiate product-related legal terms, including user agreements, terms of service, and privacy notices. 
  • Partner with cross-functional teams to identify and mitigate legal risks in product features and technologies. 

Commercial Support: 

  • Support the negotiation of commercial agreements, data processing agreements (DPAs), master service agreements (MSAs), and other vendor/customer contracts with privacy implications. 
  • Collaborate with the commercial legal team to advise on privacy-related contract provisions and cross-border data transfers. 

Privacy Compliance: 

  • Lead privacy impact assessments (PIAs) and advise on data minimization and security practices for new products and features. 
  • Monitor changes in global privacy regulations and ensure compliance with evolving standards (e.g., EU AI Act, Illinois BIPA, UK Data Protection Act). 
  • Develop and maintain privacy policies, cookie policies, and user-facing disclosures. 

Risk Management and Training: 

  • Assist in developing and managing privacy-related policies and procedures to align with internal governance frameworks. 
  • Provide training to internal teams on privacy, data protection, and compliance best practices. 
  • Identify potential privacy risks and recommend practical solutions for mitigation.
