Health Law Counsel | Regulatory & Transactional Practice

Koley Jessen seeks an experienced Health Law attorney to join its expanding Health Law Practice Group. This counsel position offers the opportunity to assume significant client responsibility, lead complex regulatory and transactional matters, and collaborate with a collegial team of attorneys dedicated to excellence in health law representation.

About the Practice

The Health Law Practice Group represents a diverse range of healthcare providers, including individual physicians, physician group practices, ambulatory surgery centers, specialty hospitals, and other healthcare facilities. The practice also represents individual providers in professional discipline matters before state licensing boards. This role does not involve personal injury litigation or medical malpractice defense.

Responsibilities

  • Advise physicians, physician groups, ASCs, specialty hospitals, and other healthcare providers on regulatory compliance, including Stark Law (Physician Self-Referral Law), the Anti-Kickback Statute, and False Claims Act matters
  • Structure, draft, and negotiate physician employment agreements, professional services agreements, medical director agreements, and joint venture arrangements with attention to healthcare regulatory requirements
  • Counsel clients on Medicare reimbursement rules and regulations, including conditions of participation, billing compliance, and payor contracting considerations
  • Advise on HIPAA compliance, healthcare privacy and data security requirements, breach response protocols, and related state privacy laws
  • Analyze and advise on corporate governance, organizational structure, and operational compliance for healthcare entities
  • Represent individual healthcare providers in professional discipline matters before the Nebraska Department of Health and Human Services and other state licensing boards, including matters involving:
    • Professional licensure investigations and proceedings
    • Medical staff credentialing and privileging disputes
    • Peer review and fair hearing proceedings
    • Hospital and health system employment matters
    • Graduate medical education program disputes
  • Conduct due diligence and provide regulatory analysis for healthcare transactions, including acquisitions, affiliations, and practice formations
  • Develop and maintain strong client relationships, serving as a trusted advisor and contributing to practice group development initiatives

Qualifications

  • Juris Doctor from an ABA-accredited law school with a strong academic record
  • Minimum of 6 years of health law experience in a law firm setting, with substantial exposure to provider-side regulatory and transactional matters
  • Demonstrated knowledge of federal healthcare regulatory frameworks, including the Stark Law (Physician Self-Referral Law), Anti-Kickback Statute, False Claims Act, and HIPAA privacy and security requirements
  • Working knowledge of Medicare rules and reimbursement regulations, including conditions of participation and billing compliance requirements
  • Familiarity with Nebraska state medical licensing statutes and regulations; experience with other state licensing frameworks is preferred
  • Experience advising physicians, physician groups, ambulatory surgery centers, and other healthcare providers on regulatory compliance and transactional matters
  • Excellent written and oral communication skills, with the ability to distill complex regulatory issues into clear, actionable guidance for clients
  • Strong analytical and problem-solving abilities, with sound judgment and meticulous attention to detail
  • Proven ability to manage multiple matters and priorities while maintaining high-quality work product under deadlines
  • Collegial, team-oriented approach with a commitment to mentoring junior attorneys and contributing to a collaborative practice environment
  • Active bar membership in Nebraska, or eligibility for admission to the Nebraska bar
