Business Trial Attorney

Atlanta, Georgia, United States; Nashville, Tennessee, United States; New York

At Morgan & Morgan, the work we do matters. For millions of Americans, we’re their last line of defense against insurance companies, large corporations or defective goods. From attorneys in all 50 states, to client support staff, creative marketing to operations teams, every member of our firm has a key role to play in the winning fight for consumer rights. Our over 6,000 employees are all united by one mission: For the People.

Morgan & Morgan Is Seeking a Business Trial Attorney

We are looking for an experienced Trial Attorney to join our Business Trial Group in Atlanta or Nashville, working directly alongside the group’s Co-Managing Chair.

Why This Role Is Different

Most business litigators spend their careers billing hours for clients who pay by the hour, and most businesses wronged by a breach of contract or professional negligence never get their day in court because they can’t afford to pursue it. We changed that. The Business Trial Group represents plaintiffs only, and only on a contingency fee basis. There are no billable hours and no busy work. We don’t just work to work. We work to win. That’s why our attorneys try multiple cases to verdict each year and win about 90% of their jury verdicts.

This is a ground-floor opportunity. You’ll bring your trial skills and judgment to a growing market, with the autonomy to run your cases your way and a role in building our presence in it. You’ll have the backing of the nation’s largest plaintiffs’ firm, a dedicated paralegal, and a small, close-knit team of about 16 attorneys that few firms can match. We are one of very few firms in the country that take on this type of case on a contingency basis, so the work is distinctive, the cases are high-value, and the opportunity to make your mark is real.

Who You’ll Work With

You’ll report to the Co-Managing Chair of the Business Trial Group, a Board-Certified Specialist in Civil Trial Law who has first-chaired multiple trials and recovered tens of millions of dollars for business clients through jury verdicts and settlements. His practice focuses on professional liability claims (legal, accounting, auditor, and engineering malpractice) and commission disputes, backed by years of experience handling complex commercial cases from inception through verdict in state and federal trial courts and on appeal. Recognized repeatedly by Florida Super Lawyers as a “Rising Star” and by Florida Trend as one of “Florida’s Legal Elite,” he built his practice on the belief that access to the civil justice system shouldn’t depend on the ability to pay hourly fees. You’ll learn from and work alongside a trial lawyer who has done exactly that.

What You Will Do

  • Handle high-value business cases from intake through trial, including motion practice, depositions, and jury trials
  • Represent victims of contract breaches, professional negligence, construction defects, and other business misconduct
  • Build and grow a book of business by developing referral relationships with other attorneys, professionals, and business owners
  • Represent the firm at conferences and industry events to expand the Business Trial Group’s reach
  • Collaborate with a talented team of trial attorneys and a dedicated paralegal

What We Are Looking For

  • JD from an ABA-accredited law school
  • 5 to 10 years of litigation experience, with meaningful trial experience
  • Active bar membership in good standing in Georgia or Tennessee (depending on office)
  • Strong litigation fundamentals: motion practice, discovery, depositions, and courtroom experience
  • A self-starter who wants autonomy and is ready to bet on themselves
  • A natural relationship builder who enjoys networking, attending conferences, and earning the trust of referral sources, because your success will depend on it

What We Offer

  • A compensation package with unlimited upside: base salary plus objective handling and generation bonuses
  • No billable hours, ever
  • Comprehensive benefits
  • A dedicated Paralegal
  • Real trial opportunities, not just the promise of them

Where We Are Hiring

This position is based in our Atlanta or Nashville office. We will also consider strong candidates based in New York.

An Invitation

If you’ve spent your career billing hours for defendants and wondered what it would look like to switch sides, this is your invitation. If you’re already a plaintiffs lawyer looking for a platform with more resources and more control, we want to hear from you. And if you’re a trial lawyer who has always wanted to build something of your own with a firm’s resources behind you, let’s talk.

At Morgan & Morgan, business trial work is not a side practice. It’s a group built on winning, and we’re growing it.
