VP of Legal Services

Position Summary:

Reporting to the CEO, the Vice President, Legal Services role provides leadership in evaluating and mitigating the broad range of legal, ethical and financial risks inherent in operating the Accanto Health and affiliates, The Emily Program and Gather Behavioral Health.

Compliance Responsibilities:

The Vice President manages team of compliance professionals and is responsible for ensuring that they maintain a highly effective Compliance Plan that:

  • Monitors and ensures compliance with state and federal laws, including healthcare regulations, licensing requirements, and accreditation standards for behavioral health facilities.
  • Monitors legislative and regulatory developments that impact multi-state inpatient and outpatient treatment centers and supports the facilities in relation to these developments as needed.
  • Continuously reviews, develops and updates policies and procedures to ensure ongoing compliance and mitigate legal risks.

The Vice President:

  • Serves as the Chair of the Compliance Committee, with reporting on compliance activities to that committee including developing appropriate compliance reports that communicate the status of the Compliance Plan to the Compliance Committee, CEO, and Governing Body.
  • Develops, implements, and updates an annual compliance risk assessment and monitoring and auditing program in accordance with the Compliance Work Plan including identifying solutions for risk mitigation as a result of such activities.
  • Leads the development of standards of business conduct, and policies and procedures to promote compliance consistent with regulatory, legal, and contractual requirements including continually monitoring and evaluating adherence.
  • Interacts directly with the applicable Governing Body, CEO, and executive and departmental management, Legal, State and Federal representatives and others as required.
  • Maintains open lines of communication with personnel at all levels.
  • Participates in privacy and security activities for the enterprise.

The Vice President and the Compliance Department are responsible for seeing that the facilities maintain a constant state of readiness for accreditation, regulatory and licensing requirements and expectations.

 

Responsibilities for Legal Affairs and Risk Management:

The Vice President also oversees all legal affairs, including contracts and regulatory matters, and coordinates risk management activities across the enterprise.  The Vice President:

  • Serves as the primary liaison to external legal counsel for contracts, compliance, and regulatory matters.
  • Serves as an internal legal resource for the organization to Review and approve contracts, ensuring compliance with organizational and regulatory standards.
  • Oversees legal communications, including those with program beneficiaries and participating providers, to ensure compliance with federal and state regulations.
  • Oversee outside counsel in litigation matters;
  • Participates in privacy and security initiatives, ensuring enterprise-wide compliance with data protection standards.
  • Develops and oversees a comprehensive risk management program, identifying risks across operational, financial, regulatory, and reputational domains.
  • Performs risk assessments and collaborate with business units to develop risk mitigation strategies.
  • Leads risk analysis related to strategic decisions and business initiatives in accordance with HIPPA, protection and sharing of PHI/ePHI.
  • Oversees crisis management planning and business continuity processes, ensuring the company is prepared for unexpected disruptions.
  • Participates on a multidisciplinary team that responds during a crisis or emergency and facilitates contact with external regulatory bodies.
  • Fosters a collaborative environment that ensures alignment between legal, risk management, and business teams.
  • Acts as a subject matter expert in HIPPA, 42 CFR and related privacy laws for organization and its’ members

Accreditation and Licensure:

The Vice President, together with the Compliance Department, is also responsible for:

  • Maintaining and overseeing the various accreditation and license requirements, including compliance with all applicable policies and procedures, and regulatory requirements.
  • Facilitating site preparation for license and accreditation surveys.
  • On the ground management during any outside review for accreditation and license renewals.


Qualifications:

The ideal candidate will bring deep regulatory expertise, a proven track record in healthcare legal management, and the ability to navigate multi-state legal landscapes and have:

  • 10+ years relevant Legal and industry experience, and management skills.
  • Completed Juris Doctor (JD) degree from an American Bar Association (ABA)-accredited law school, and Pass required Bar exam. Preference for MN Licensure. 
  • Experience working with Joint Commission and CARF accredited Healthcare facilities.
  • An undergraduate degree is required; focus on Business, Healthcare, Public Policy, or other related area is preferred.
  • Demonstration of utmost integrity in the handling of confidential materials and information, and experience working in highly regulated environments.
  • Familiarity with managed care, reimbursement policies, and insurance regulatory issues.
  • Expert in driving interdepartmental and cross-functional strategy creation and proven success leading the development and management of compliance programs.
  • Known as a highly effective and collaborative strategic compliance leader, with exceptional interpersonal abilities that foster enthusiasm, teamwork, collaboration, and a culture of accountability.
  • Experience working closely with outside entities, including vendors, CMS, external association representatives, consultants, and other compliance professionals, to ensure compliance with federal and state regulatory requirements.
  • Excellent oral, written and presentation skills, as well as conceptual and analytics skills necessary to comprehend and articulate corporate objectives and federal and state regulations across relevant audiences.
