This role is onsite 5 days a week in Fremont, CA
(with the option to work in other Company offices two days per week)
About the Role
The Senior Counsel, Product & Privacy will provide strategic and hands-on legal support for the Weee! platform, covering both first-party (1P) and marketplace operations. As a senior legal team member, this highly visible role serves as the primary legal advisor on product, privacy, intellectual property, and marketing matters, working closely with Product, Engineering, and Marketing teams. Responsibilities include legal guidance on marketing (including sweepstakes and contests), social media, and intellectual property matters ensuring Weee!’s practices comply with applicable laws and industry standards. The Senior Counsel will manage Weee!’s terms of service and privacy policy, and support expansion with new apps and product categories, including regulated items such as alcohol. This role is also responsible for drafting, reviewing, negotiating, and managing contracts related to marketing, advertising, intellectual property, and other relevant areas. Reporting directly to the General Counsel, the Senior Counsel may also assist with other legal matters as needed.

Responsibilities
• Serve as the primary legal advisor for all product, privacy, and intellectual property matters related to the Weee! platform, including both 1P and marketplace operations.
• Draft, review, and update Weee!’s terms of service, privacy policy, and related customer-facing legal documents.
• Provide legal support for advertising and marketing initiatives, including review of campaigns, promotions, sweepstakes, contests, and customer communications to ensure compliance with consumer protection, privacy, and advertising laws.
• Advise on legal and regulatory requirements for new apps and product categories, including alcohol and other regulated SKUs, ensuring compliance with federal, state, and local laws.
• Manage privacy and data protection compliance processes in partnership with other cross-functional teams.
- Assist the Food Safety team, on risk mitigation and legal matters.
• Advise on social media activities ensuring regulatory compliance and best practices.
• Draft, review, negotiate, and manage contracts related to marketing, advertising, intellectual property, and other relevant areas, ensuring agreements protect the company’s interests and comply with applicable laws.
• Advise on intellectual property matters, including trademark and copyright issues, and support the protection and enforcement Weee!’s IP portfolio, including private label products.
• Provide legal support for product and IP disputes as needed.
• Partner with the Product teams to identify and address legal risks in new features, platform changes, and business initiatives.
• Monitor and interpret changes in privacy, consumer protection, and product-related laws and regulations, proactively updating policies and practices to ensure compliance.
• Develop and deliver training for business teams on privacy, product compliance, advertising law, and intellectual property requirements.
• Manage external counsel on specialized product, privacy, IP litigation, and regulatory matters as needed.
• Advise and support the Customer Service team on legal issues related to customer interactions, escalations, and dispute resolution.
• Assist with other legal matters and cross-functional projects as requested.
Qualifications
• JD degree; member of CA state bar in good standing.
• 8+ years of relevant legal experience, including at least 3 years at a law firm in a related area.
• In-house legal experience at a technology, e-commerce, or retail company strongly preferred.
• Deep expertise in product compliance and consumer protection, including experience drafting and maintaining terms of service and privacy policies.
• Strong background in advertising and marketing law, including review of campaigns, promotions, sweepstakes, contests, social media, and marketing/ad agreements.
• Experience drafting, reviewing, negotiating, and managing contracts related to marketing, advertising, intellectual property, and other relevant areas.
• Experience with intellectual property matters, including trademark, copyright, patent, and IP litigation.
• Demonstrated experience advising on legal and regulatory requirements for new product expansions.
• Proven ability to partner with cross-functional teams and provide clear, practical legal advice in a fast-paced environment.
• Excellent written and verbal communication skills, with the ability to translate complex legal concepts for non-legal audiences.
• Strong business judgment, balancing legal compliance with business objectives.
• Ability to independently manage multiple projects and priorities.
• Versatility and willingness to take on legal matters outside of core areas as needed.
• Experience developing and delivering effective legal training programs is a plus.
• Strong interpersonal skills and ability to handle sensitive matters with discretion and professionalism.

Compensation Range
- The US base salary range for this full-time position is $178,000-210,000
- This role may be eligible to discretionary bonus, incentives and benefits
- Our salary ranges are determined by role, level, and location
